Welcome to CaryMarijuana.Clinic (the "Site," "we," "us," or "our"). By accessing or using this Site, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use ("Terms"). If you do not agree, please do not use this Site.

1. About This Site — Information & Marketing Platform Only

CaryMarijuana.Clinic is an information and marketing website. We provide general information about the Eastern Band of Cherokee Indians (EBCI) Medical Cannabis Program and facilitate access to third-party telehealth booking services. This Site does not provide medical services, issue cards, render clinical advice, or participate in any clinical decision-making.

We are not a medical practice, pharmacy, dispensary, or healthcare provider. We are not affiliated with, endorsed by, or acting on behalf of the Eastern Band of Cherokee Indians, the EBCI Cannabis Control Board, or any government agency. North Carolina does not operate a comprehensive state medical marijuana program; the EBCI program described on this Site is operated by a sovereign tribal nation and applies only on Tribal land.

All appointment scheduling services are facilitated through Acuity Scheduling, an independent third-party booking platform. All clinical services are provided solely by independent North Carolina-licensed MDs and DOs who are not employees, agents, or representatives of this Site.

2. Independent North Carolina-Licensed Providers

When you book an appointment through this Site, you are scheduling with an independent, third-party North Carolina-licensed MD or DO who can sign the Doctor's Attestation form required by the EBCI Cannabis Control Board. These providers are solely responsible for:

  • Evaluating your medical situation under applicable law
  • Conducting the telehealth evaluation in accordance with applicable North Carolina telemedicine standards and professional licensing requirements
  • Making all clinical decisions
  • Signing or declining to sign a Doctor's Attestation in their sole professional discretion
  • Compliance with all applicable state and federal laws and regulations

We do not supervise, direct, credential, control, or employ any practitioner. No provider–patient relationship exists between you and CaryMarijuana.Clinic.

3. No Guarantee of Outcomes

We do not guarantee that a provider will sign a Doctor's Attestation, that the EBCI Cannabis Control Board will approve your Patient Card application, or that an appointment will be available at a particular time or price. Attestation decisions are made solely by the independent provider. Patient Card approval decisions are made solely by the EBCI Cannabis Control Board.

4. Eligibility

Use of this Site is intended for adults at least 21 years of age who are North Carolina residents. Per the EBCI Cannabis Control Board, applicants must be at least 21 years old and must show proof of North Carolina residency with a government-issued ID. Consult the EBCI Cannabis Control Board FAQs for current eligibility rules.

5. Booking, Payments & Refunds

Appointment booking is facilitated through Acuity Scheduling. Payment may be made by major credit card at the time of booking. Refund eligibility is governed by the policy disclosed at booking and/or the independent provider's posted policy.

The EBCI patient card fee — $100 for North Carolina residents (or $50 for enrolled EBCI members) — is paid directly to the EBCI Cannabis Control Board through the EBCI online patient portal and is non-refundable per EBCI policy. CaryMarijuana.Clinic does not collect any portion of the EBCI fee.

6. Accuracy of Information

We make reasonable efforts to keep information on this Site up to date. Always verify program details with the official EBCI Cannabis Control Board.

7. Prohibited Use

You may not use this Site for any unlawful purpose, to solicit illegal activity, to interfere with Site security or functionality, to submit false or misleading information, or to harm others.

8. Intellectual Property

All content on this Site is the property of CaryMarijuana.Clinic and is protected by applicable copyright laws. You may not reproduce, distribute, or modify any content without prior written permission.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CARYMARIJUANA.CLINIC AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THIS SITE, YOUR INTERACTIONS WITH ANY PRACTITIONER OR THIRD-PARTY PLATFORM, OR ANY CLINICAL OUTCOME OR REGISTRY DECISION. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID TO CARYMARIJUANA.CLINIC, IF ANY, IN THE SIX MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR $100, WHICHEVER IS GREATER.

10. Indemnification

You agree to defend, indemnify, and hold harmless CaryMarijuana.Clinic and its affiliates, officers, directors, employees, and agents from any claims, damages, liabilities, losses, and expenses (including attorneys' fees) arising from your use of this Site, your violation of these Terms, or your alleged violation of any law or third-party rights.

11. Disclaimer of Warranties

THIS SITE IS PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM ALL WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

12. Dispute Resolution; Arbitration; Class Action Waiver

Please read this section carefully — it affects your legal rights.

Before filing any claim, you agree to contact us and attempt to resolve the dispute informally for 30 days. Unresolved disputes shall be settled through final and binding arbitration administered by the American Arbitration Association (AAA). Class actions, class arbitrations, and representative proceedings are not permitted. You waive the right to a jury trial.

Jurisdiction and Venue: Exclusive jurisdiction and venue of any actions arising out of, or relating to or in any way connected with your access and/or use of this Site shall be in Bexar County, Texas if in state court, and in the Western District of Texas in San Antonio, Texas if in federal court.

13. Governing Law

All matters relating to your access and use of this Site shall be governed by the federal laws of the United States and the laws of the State of North Carolina, without reference to conflict of laws principles.

14. Changes to Terms

We reserve the right to modify these Terms at any time. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.

North Carolina has no state medical marijuana program, and cannabis remains illegal under North Carolina state law and federal law everywhere off Tribal land. The EBCI Medical Cannabis Patient Card is valid only on the Qualla Boundary and other EBCI trust lands in western North Carolina. Health insurance does not cover the cost of the consultation, the Doctor's Attestation, or the EBCI patient card fee. Advertising & Compensation Disclosure

CaryMarijuana.Clinic is an information and marketing website. We may receive compensation from North Carolina-licensed MDs and DOs and telehealth booking services for advertising and marketing services. Such compensation is not based on the provision of medical services, patient outcomes, or attestation decisions.

Nothing on this Site should be construed as a direction, recommendation, or endorsement of any particular healthcare provider or telehealth service.

Acknowledgement of Federal Law

By using this Site, you acknowledge that CaryMarijuana.Clinic is designed for residents of North Carolina seeking a Doctor's Attestation for the EBCI Medical Cannabis Program — a program operated by the Eastern Band of Cherokee Indians, a sovereign tribal nation, and valid only on Tribal land. North Carolina does not operate a comprehensive state medical marijuana program, and cannabis remains illegal under North Carolina state law off Tribal land.
